Terms of Service

You must be at least 18 years old to access or use UncensoredArt.ai.

By accessing or using the Service, you represent and warrant that:

• you are at least 18 years old;
• you have the legal capacity to enter into these Terms;
• your use of the Service is permitted under the laws applicable to you; and
• you will comply with these Terms and all applicable laws.

We may suspend or terminate an account if we reasonably believe that the account is being used by a person under 18.

UncensoredArt.ai provides access to artificial intelligence tools that may allow users to create, modify, transform, generate, or process content including:

• images;
• videos;
• audio;
• music;
• speech;
• voice clones;
• face swaps;
• animations;
• 3D assets;
• visual effects;
• edited media;
• AI-generated creative works; and
• other digital media.

Some AI models are hosted or operated directly by us, while other models or functionality may be provided through third-party AI models, infrastructure providers, APIs, or technology partners.

Features, models, credit costs, availability, generation speeds, technical requirements, and capabilities may change over time.

Certain features may require an account.

You agree to provide accurate information when creating and maintaining your account.

You are responsible for:

• maintaining the confidentiality of your login credentials;
• activities performed through your account;
• preventing unauthorized access to your account; and
• notifying us if you suspect unauthorized access or misuse.

You may not sell, transfer, rent, or provide your account to another person without our permission.

We may restrict, suspend, or terminate accounts that violate these Terms or present security, legal, safety, fraud, or abuse risks.

"User Content" includes content you submit, upload, transmit, provide, or otherwise make available through the Service, including:

• prompts;
• text;
• photographs;
• images;
• videos;
• audio;
• voice recordings;
• face images;
• reference images;
• files; and
• other materials.

You retain your rights in your User Content.

You are solely responsible for User Content you upload or provide to the Service.

By submitting User Content, you represent and warrant that you have all rights, permissions, licenses, and consents necessary to upload, process, modify, generate from, or otherwise use that content through the Service.

Some features may permit users to upload or process photographs, faces, voices, videos, likenesses, or other content relating to real individuals.

You are solely responsible for ensuring that your use of such material is lawful.

You must have the necessary authorization, permission, consent, ownership rights, licenses, or other lawful basis to upload and use another person's:

• photograph;
• face;
• likeness;
• voice;
• video;
• performance;
• personal information; or
• other protected material.

You may not use the Service to impersonate, exploit, defraud, harass, deceive, threaten, or harm another person.

You may not create or distribute non-consensual intimate or sexual content depicting or purporting to depict another identifiable person.

The fact that the Service technically allows a particular generation or transformation does not mean that your use of that feature is lawful or permitted under these Terms.

UncensoredArt.ai may permit certain mature or adult-oriented artistic content where permitted by applicable law and these Terms.

Permitted mature content remains subject to strict restrictions.

You may not create, upload, request, distribute, or attempt to create content involving:

• minors in any sexual, sexually suggestive, exploitative, or inappropriate context;
• child sexual abuse material or content resembling or depicting child sexual exploitation;
• sexualization of anyone under 18, whether real, fictional, generated, or altered;
• non-consensual intimate imagery;
• sexual deepfakes of identifiable people without their explicit consent;
• sexual violence or exploitation;
• trafficking or sexual exploitation;
• unlawful pornography;
• content created or distributed in violation of another person's privacy or publicity rights; or
• other unlawful sexual content.

We reserve the right to remove content and suspend or terminate accounts where we believe these restrictions have been violated.

You may not use UncensoredArt.ai to create, upload, facilitate, promote, distribute, or engage in:

Illegal Activity

Any activity that violates applicable law or regulation.

Child Exploitation

Any sexual, exploitative, abusive, or inappropriate content involving minors.

This prohibition applies to real, fictional, generated, manipulated, or synthetic depictions.

Non-Consensual Sexual Content

Sexual or intimate content depicting an identifiable individual without appropriate consent.

Fraud and Impersonation

Fraud, scams, phishing, identity theft, deceptive impersonation, or misleading representations intended to cause harm.

Harassment and Abuse

Threats, targeted harassment, stalking, intimidation, blackmail, extortion, or abuse.

Privacy Violations

Doxxing, unauthorized disclosure of personal information, invasion of privacy, or unlawful use of another person's likeness, image, or voice.

Copyright and Intellectual Property Violations

Content that infringes copyrights, trademarks, publicity rights, privacy rights, trade secrets, or other intellectual property rights.

Terrorism and Extremism

Content supporting, facilitating, recruiting for, materially assisting, or promoting terrorist organizations or unlawful extremist activities.

Illegal Goods and Services

Content designed to facilitate unlawful trafficking, transactions, goods, or services.

Harmful or Abusive Deepfakes

Deepfakes or synthetic media created for unlawful deception, fraud, harassment, exploitation, or non-consensual sexual use.

Malicious Activity

Attempts to attack, compromise, disrupt, reverse engineer, scrape, overload, abuse, or circumvent the security or technical restrictions of the Service.

We may investigate suspected violations and take appropriate action, including limiting generation capabilities, removing content, suspending access, terminating accounts, preserving relevant records where legally required, or cooperating with lawful authorities.

Subject to these Terms, users may use outputs generated through UncensoredArt.ai for personal or commercial purposes.

As between you and UncensoredArt.ai, to the extent that we possess rights in an output generated specifically for you, we grant or assign those rights to you to the maximum extent permitted by applicable law.

Your ability to obtain copyright or other intellectual property protection for AI-generated material depends on applicable law and the circumstances surrounding the creation of the work.

Commercial use does not override:

• applicable law;
• third-party intellectual property rights;
• privacy rights;
• publicity rights;
• contractual restrictions;
• permissions relating to uploaded materials; or
• restrictions applicable to particular third-party models.

You remain responsible for ensuring that your intended use of an output is lawful.

We do not use your private prompts, uploaded content, generated images, videos, audio, voice samples, or other private generations to train or improve our AI models.

We also do not place private customer generations into our public showcase or gallery without the user's permission.

If we wish to feature your work in a showcase, gallery, marketing material, or similar public presentation, we will request permission.

You are free to decline.

To provide the Service, you grant us a limited, non-exclusive license to host, store, copy, transmit, process, modify, and otherwise technically use User Content only as reasonably necessary to:

• provide your requested generation or processing;
• operate the Service;
• store your generation history during the applicable retention period;
• detect fraud, abuse, or security threats;
• comply with legal obligations; and
• provide customer support.

This operational license does not authorize us to use your private content for AI model training.

Prompts, generations, uploaded images, uploaded videos, uploaded audio, voice samples, and similar content may generally be retained for up to 30 days.

After the applicable retention period, such content is scheduled for deletion from our active systems, subject to limited exceptions where longer retention is reasonably necessary for:

• security;
• fraud prevention;
• backup systems;
• dispute resolution;
• enforcement of these Terms; or
• legal or regulatory obligations.

Deletion from backups and distributed systems may not occur immediately.

Users may also have options to delete content or their account earlier through available account features or by contacting us.

The Service may incorporate, connect to, or provide access to third-party AI models, infrastructure, APIs, software, hosting providers, or other services.

Third-party technology may have its own limitations, terms, acceptable-use requirements, availability, or restrictions.

Models may be added, replaced, modified, temporarily unavailable, or permanently removed.

We do not guarantee continued availability of any particular AI model, provider, generation method, feature, speed, output format, or capability.

We may substitute technology where reasonably necessary to operate the Service.

Certain functionality requires credits.

The number of credits required for a generation or operation may vary based on factors such as:

• AI model;
• resolution;
• duration;
• quality;
• computing requirements;
• output quantity;
• feature; or
• other processing requirements.

Credit pricing and consumption rates may change prospectively.

Credits:

• have no cash value;
• are not currency;
• cannot be transferred between accounts;
• cannot normally be exchanged for cash;
• may expire according to the validity period associated with the applicable purchase or promotion; and
• may only be used for eligible features of the Service.

Where a generation fails due to a qualifying technical failure and the Service determines that the requested output was not successfully generated, applicable generation credits may be returned to the user's account.

Credit restoration is not necessarily available where failure results from:

• prohibited content;
• violation of these Terms;
• invalid inputs;
• user error;
• unsupported files;
• connectivity problems outside our systems; or
• circumstances where generation resources were successfully consumed and an output was produced.

Eligible purchases may be refunded if a refund request is submitted within 24 hours of purchase and the account has used no credits or only a minimal portion of the purchased credits.

Refund requests may be denied where there has been substantial use of purchased credits.

Nothing in this section limits any mandatory consumer rights that cannot lawfully be waived.

You may stop using the Service at any time.

Where account deletion functionality is available, you may request deletion of your account and associated information.

We may suspend, restrict, or terminate your access immediately if we reasonably determine that:

• you violated these Terms;
• your activity creates legal or security risk;
• your activity involves prohibited content;
• your activity threatens other users or third parties;
• your account is involved in fraud or abuse;
• payment fraud or chargeback abuse has occurred; or
• suspension is required by law.

Serious violations may result in permanent account termination.

Except for User Content and generated outputs addressed above, UncensoredArt.ai and its licensors retain their rights in the Service, including its:

• website;
• software;
• interfaces;
• designs;
• branding;
• logos;
• technology;
• databases;
• documentation; and
• proprietary systems.

These Terms do not grant you ownership of the Service or its underlying technology.

If you voluntarily submit suggestions, feedback, bug reports, ideas, or recommendations about the Service, you grant us permission to use that feedback without restriction or compensation to improve our products and services.

This section does not apply to your private generated content.

AI services rely on complex computing systems and third-party infrastructure.

The Service may occasionally experience:

• delays;
• maintenance;
• outages;
• generation failures;
• capacity limits;
• model downtime;
• performance changes; or
• feature changes.

We may modify, discontinue, replace, restrict, or update portions of the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

UNCENSOREDART.AI DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE EXTENT PERMITTED BY LAW.

We do not warrant that the Service will always be uninterrupted, error-free, secure, or available.

Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNCENSOREDART.AI AND ITS OPERATORS, AFFILIATES, SERVICE PROVIDERS, CONTRACTORS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL ARISING FROM OR RELATING TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO UNCENSOREDART.AI DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

These limitations apply only to the extent permitted by applicable law.

To the extent permitted by law, you agree to indemnify and hold harmless UncensoredArt.ai and its operators, personnel, contractors, service providers, and affiliates from claims, liabilities, damages, costs, and reasonable legal expenses arising from:

• your User Content;
• your unlawful use of generated content;
• your violation of these Terms;
• your infringement of another person's rights; or
• your unlawful use of another person's image, face, voice, likeness, or other content.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Nothing in these Terms deprives a consumer of mandatory protections available under applicable law.

We may update these Terms when our services, business practices, technologies, or legal obligations change.

The updated Terms will be posted on the Service with a revised "Last Updated" date.

Where required by law, we will provide additional notice or request consent before material changes take effect.

Continued use of the Service after updated Terms become effective constitutes acceptance to the extent permitted by law.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions remain in effect.

These Terms, together with the Privacy Policy, Purchase & Credit Terms, and any additional terms presented for a specific feature or service, constitute the agreement governing your use of UncensoredArt.ai.
